The trucking industry reached a critical turning point on March 16, 2026. A sweeping new final rule from the Federal Motor Carrier Safety Administration (FMCSA) has officially taken effect, fundamentally altering the eligibility landscape for non-domiciled commercial drivers. Estimates suggest that approximately 200,000 immigrant truck drivers—roughly 5% of the total U.S. CDL workforce—will lose their licenses as they expire under these new standards.

What Changed Overnight?
The core of the “Restoring Integrity to the Issuance of Non-Domiciled CDLs” rule is the restriction of eligibility to specific visa categories. Previously, many drivers could obtain or renew a CDL using a valid Employment Authorization Document (EAD). As of March 16, EADs alone are no longer accepted.
Eligibility is now strictly limited to non-citizens holding one of three specific nonimmigrant statuses:
- H-2A (Temporary Agricultural Workers)
- H-2B (Temporary Non-Agricultural Workers)
- E-2 (Treaty Investors)
This means that hundreds of thousands of drivers currently operating under DACA, Temporary Protected Status (TPS), asylee, or refugee status are now ineligible for CDL renewals.
The Mandatory SAVE Verification
Efficiency in compliance now depends on the SAVE system (Systematic Alien Verification for Entitlements). States are now required to query this federal database for every issuance, renewal, or upgrade. If the SAVE response does not confirm one of the approved visa types, the application must be denied. Furthermore, the validity of any issued license can no longer exceed the “Admit Until Date” on the driver’s Form I-94, or one year—whichever is shorter.
