CDL Consultant, Inc. Terms of Service

Introduction

In order to use cdlconsultants.com (“Website”) or make use of the services provided by CDL Consultants, Inc. (“CDL Consultants”, “Company”, “we”, “us”, and “our”) (the “Service” or “Services”), you (“You”, “Your”) must read and accept this Agreement.

You accept these Terms by:

  • Using the website
  • Using services
  • Submitting information
  • Communicating with CDL Consultants
  • Opting into communications

If you do not agree, do not use the Website or Services.

You may not use services if:

  • You are under 18
  • You cannot legally contract
  • You are restricted by law


If accepting on behalf of a company you confirm authority.

CDL Consultants:

  • Is not a law firm
  • Does not provide legal advice
  • Does not create attorney client relationships
  • Does not guarantee legal outcomes

We assist with:

  • Attorney coordination
  • Case communications
  • Administrative support
  • Paperwork assistance


Legal outcomes are determined by courts and attorneys.

We grant a limited:

  • Non-exclusive license
  • Revocable license
  • Non-transferable license


You may not:

  • Copy systems
  • Resell services
  • Reverse engineer
  • Provide unauthorized access


All rights remain CDL Consultants property.

Services may be interrupted due to:

  • Maintenance
  • Security issues
  • System outages
  • Legal requirements


We are not liable for downtime.

You agree to pay all fees.

All fees exclude taxes.

Disputes must be filed within 90 days.

Refunds determined case-by-case.

No refunds if:

  • Attorney already filed case
  • Case reopened
  • Instructions ignored
  • Work already performed


Possible refund if:

  • Cancel within 24 hours
  • Court date not imminent


Refunds may include 10% administrative deduction.

Refund acceptance includes legal release of claims.

CDL Consultants owns:

  • Software
  • Branding
  • Systems
  • Documents
  • Processes


Users retain ownership of submitted data.

Feedback becomes CDL Consultants property.

We disclaim:

  • Merchantability
  • Fitness for purpose
  • Performance guarantees

We do not guarantee:

  • Results
  • Outcomes
  • Continuous service

We are not liable for:

  • Lost profits
  • Data loss
  • Business losses
  • Indirect damages


Liability limited to fees paid.

We may use:

  • SMS providers
  • Hosting providers
  • Payment processors


We are not responsible for third-party performance.

You agree to indemnify CDL Consultants against claims resulting from:

  • Your use
  • Your violations
  • Your negligence

Illinois law governs.

Venue:

Disputes resolved through arbitration.

AAA rules apply.

No class actions.

No jury trials.

I don't use a legal plan for my drivers. It's hard for me to say "don't get tickets" and then offer them a legal plan. Having CDL Consulants when my drivers get tickets (because even the best drivers are going to get a ticket here and there) is the best solution for us. I received a ticket in Alabama for speeding a few months ago. I didn't get the chance to go to my court date and and Failure to Appear was issued. I immediately called CDL Consultant and asked for help. They found me a local attorney that was able to go in and effectively defend my case and got the speeding ticket reduced to an equipment violation and the FTA removed. They really worked hard on my case and I really enjoyed working with their attorney.
